Evansville Man Fired for Eating Hot Dogs Wins Court Case

Have you heard yet about the Evansville, Indiana, man who was fired after eating a hot dog on the job? There’s no real punchline here, but after Nolan Koewler was fired from his job last year at Dillards, he took his former employer to court to ensure that the joke was on them.

A panel of three judges recently decided that Koewler was unjustifiably fired on July 5, 2010. The day before he was fired the man had attended a July Fourth cookout held for employees by Dillards. At the event’s end, the manager said that the leftover food should be taken to the break room freezer to eat on Labor Day.

Koewler says he never heard those instructions and the day after the cookout he ate two of the leftover hot dogs that were in the break room. This act was captured on surveillance video.

According to the case summary, “At a meeting with the store manager, Koewler admitted the truth of the allegation. A police officer was summoned, and the store manager advised Koewler that he had a choice: sign a statement that he stole two leftover hotdogs from the Fourth of July independence celebration for employees or spend the night in jail. Koewler signed a statement admitting theft. He was then discharged from his employment.”

The man was then denied unemployment benefits.

On July 7, 2011, the Indiana Court of Appeals ruled that there was no proof that Koewler knew of the instructions not to eat the hot dogs and that Dillards must pay Koewler unemployment benefits.

Evansville Teen on Bicycle Hit By Truck

July 12, 2011

A 16-year-old Evansville, Indiana, boy was hit by a pickup truck on Tuesday, July 5 while riding his bicycle. The boy had been trying to cross Diamond Avenue at First Avenue, according to an accident report, and was moving against a red light when the truck struck him.

The boy was knocked unconscious and suffered a head injury. Though he was initially taken to Deaconess Hospital, he’s since been transported via LifeFlight to Riley Children’s Hospital in Indianapolis.

According to a Facebook status update from the victim’s father on Tuesday, the boy is now “awake and totally off life support.” This will allow doctors to proceed with an MRI of his brain to determine how much damage has been done.

The Evansville Courier reports that the boy is expected to remain hospitalized for three or four months.

“At this point, he still doesn’t know what’s happened,” the father told the paper of his son, who is a former Bosse High School student who planned to enroll at Harrison High School in the fall. “He just kind of opens his eyes, and you see him searching for something.”

Anti-Smoking Drug Chantix Gets Further Scrutiny for Heart Risks

The U.S. Food and Drug Administration (FDA) may add new warnings to Phizer’s anti-smoking prescription drug Chantix now that a study has determined that the drug increases the risk of hospitalizations for heart problems by 72 percent.

The study was conducted by researchers in Baltimore at Johns Hopkins University who looked at 8,216 people who were taking Chantix and determined that 1 in 400 of these people had a new heart attack or similar disorder.

“I stopped prescribing Chantix several months ago, as soon as we found out about this data,” said Sonal Singh, the lead author of the study who practices medicine at Johns Hopkins. “I’m not saying that nobody should use it, but I think people should have this information. They should decide whether the risk is acceptable to them.”

The FDA Office of Drug Evaluation Director Curtis Rosenbraugh told the Associated Press that the FDA is now analyzing the study to determine whether or not it should add new warnings to the medication.

In 2009 the FDA warned consumers that Chantix might cause an increase in suicides and erratic behavior, and just last month a warning was added for patients taking Chantix who have a history of heart disease.

In an emailed statement a Phizer rep argues that “the health benefits of quitting smoking are immediate and substantial,” adding that they believe the study misinterpreted data.

Mecca Fire Chief Arrested After Killing 1 and Injuring Another in DUI Crash

Michael R. Collom—the fire chief in Mecca, Indiana—was arrested early this morning and now faces serious charges after crashing his car though a home in Mecca. A 43-year-old man inside the home was killed and his wife was injured when the car plowed through their bedroom.

Parke County Chief Deputy Sheriff Bill Todd told The Tribune-Star that Collom could face a Class C felony charge of operating a vehicle while intoxicated resulting in a death. He now sits in Parke County Jail without bail.

The crash occurred on Craig Street at 4:46 a.m. on Tuesday when Collom lost control of his 2006 Ford Mustang while driving down Wabash Road.

The male homeowner was pronounced dead at the scene by a pair of Parke County deputy coroners. A helicopter transported his 46-year-old wife to Methodist Hospital in Indianapolis. The four children in the house were not injured.

Following the crash, Collom performed an alcohol field test. He was also later given a blood test at Union Hospital Clinton. He is being held without bail.

Number of Boating Deaths Down in Indiana

Fatal boating accidents in Indiana have been cut in half since 2009, according to a new statement from the U.S. Coast Guard.

In 2009, boating-related deaths in Indiana had reached a five-year high. That year there were 13 fatal accidents that resulted in 13 deaths, compared with six fatal accidents that resulted in eight deaths in 2010.

One such accident occurred last summer when a speed boat collided with a fishing boat on Lake Monroe in Bloomington, killing a 51-year-old woman and her eight-year-old grandson.

Despite the positive trending toward fewer fatalities, the overall number of Indiana boating accidents and injuries remains steady–42 in 2009 and 43 in 2010. This number is down, though, from a spike in accidents–55 total–seen in 2008.

Across the nation, boaters are becoming more safety-minded so that the total number of fatalities in the U.S. fell to a record low of 672, four less than the previous record set in 2004.

The U.S. Coast Guard urges all boaters to take a safety course, as education has been the key factor linked with avoiding injury and death.

About 75 percent of all fatal boating accidents are drownings, and the U.S. Coast Guard reports that nearly 90 percent of those victims weren’t wearing life jackets.

8 Semis Collide on I-70 Near Terre Haute

Eight semitrailers collided on Monday evening in a chain-reaction crash at the 4-mile marker on I-70 near Terre Haute, Indiana. No passenger cars were involved.

Police told The Indianapolis Star that no one suffered life-threatening injuries but that three drivers and one passenger were treated for leg and back pain at hospitals in Terre Haute.

In a news release Sergeant Joe Watts said the crash occurred around 6:45 p.m. in a construction zone where eastbound traffic had been funneled into one lane.

The Tribune-Star reports that the first tractor—a 1999 Western Star—braked for traffic that was stopped for unknown reasons. That truck was then hit by a 1999 Volvo tractor, which was then hit by another tractor and so on and on and on and on and on.

The cabs of several semis were crushed during the accident.

Police said that no drugs and alcohol were involved and that they’ve issued no citations in the crash while they continue to investigate.

The crash impeded traffic for about eight hours during clean-up of the substantial wreckage—shutting down westbound I-70 traffic for an hour and shutting down eastbound lanes until 2 a.m.

Several injured in Indiana auto accident

According to law enforcement officials, the Indiana auto accident took place when the driver of a Toyota 4Runner lost control and crossed the median into the opposite lane in the Indiana auto accident.

Busses colide in Indiana auto accident

Nearly 30 students were taken to local hospitals to be examined by medical professionals after the Indiana auto accident.
