Who is liable for my defective product injury?
If you were injured by a defective product, you may be able to receive compensation for your injuries. The settlement you may be owed might come from the defective products manufacturer, retailer, or wholesaler. Some settlements may come from more than one defendant.
The manufacturer is the first in the line of distribution. If a manufacturer develops and makes a defective product, they may be liable for that defective product. Unfortunately, many products are deigned defectively from the beginning. Other defective products may have been manufactured defectively and therefore the manufacturer is liable. Manufacturers are often the party held liable in defective product lawsuits.
The retail store that sold the product does not also have to be the manufacturer to be held liable in a defective product lawsuit. Because the retailer is a part of the distribution chain, the retailer may be liable for the defective product. For defective product lawsuits against retailers, remember:
- You don’t have to be the buyer.
- You don’t have to be the user of the product.
- You can still sue if the product is used.
A wholesaler may have been involved in the distribution chain between the manufacturer and retailer. The wholesaler is also considered a part of the distribution chain and may also be held liable in a products liability lawsuit.
